Statement by Sri Lanka at the Interactive Dialogue with the Assistant Secretary General for Human Rights on the report of the Secretary-General on co-operation with the United Nations

Item 5: Interactive dialogue with the Assistant Secretary General for Human Rights on the report of the Secretary-General on co-operation with the United Nations, its representatives and mechanisms in the field of human rights

 Statement by Sri Lanka

Madam President,

The Government of Sri Lanka (GoSL) wishes to make the following observations with regard to the reference contained in the Annual Report of the Secretary-General on "Cooperation with the United Nations, its representatives and mechanisms in the field of human rights", presented to this Council:

• With regard to alleged “intimidating visits”, “surveillance”, complaints of harassment” and “reprisals” referred to in the Report, the GoSL wishes to make an invitation to the parties concerned to make formal complaints to law enforcement authorities or to independent national institutions such as the Human Rights Commission of Sri Lanka or the National Police Commission, so that action can be taken to investigate the alleged incidents.

• The Government has already publicly refuted these allegations, and is committed to protecting and promoting freedom of expression and civil society space, and ensure that complaints received on alleged attacks against journalists, human rights defenders and civil society are investigated and prosecuted.

• It is also reiterated that, apart from operating routine security networks in the interest of national security, particularly after the devastating Easter Sunday terrorist attacks, the Security Forces and intelligence agencies are not engaged in monitoring any specific group of people in the country.

• We believe that, for any country compromising its national security interests amidst looming sophistication of strategies of radical and extreme elements world around, is bound to face regrettable consequences. Hence, the GoSL requests all parties to be mindful of that ground reality in this context.

මෙම කවුන්සිලයට ඉදිරිපත් කරන ලද මහලේකම්වරයාගේ වාර්ෂික වාර්තාවේ අඩංගු “එක්සත් ජාතීන්ගේ සංවිධානය, එහි නියෝජිතයින් සහ මානව හිමිකම් ක්‍ෂේත්‍රයේ යාන්ත්‍රණ සමඟ සහයෝගීතාව” පිළිබඳ සඳහන සම්බන්ධයෙන් පහත දැක්වෙන නිරීක්ෂණ ඉදිරිපත් කිරීමට ශ්‍රී ලංකා රජය අපේක්ෂා කරයි:

• එම වාර්තාවේ සඳහන් “බිය ගැන්වීම්”, “ආවේක්ෂණය”, “හිරිහැර කිරීම් පිළිබඳ පැමිණිලි” සහ “පළිගැනීම්” සම්බන්ධයෙන්, නීතිය ක්‍රියාත්මක කරන බලධාරීන්ට හෝ ශ්‍රී ලංකාවේ මානව හිමිකම් කොමිසම හෝ ජාතික පොලිස් කොමිසම වැනි ස්වාධීන ජාතික ආයතන වෙත විධිමත් ලෙස පැමිණිලි කිරීමට අදාළ පාර්ශ්වයන්ට ආරාධනා කිරීමට රජය අපේක්ෂා කරන අතර, ඒ අනුව චූදිත සිදුවීම් පිළිබඳව විමර්ශනය කිරීමට පියවර ගත හැකිය.
• රජය මෙම චෝදනා දැනටමත් ප්‍රසිද්ධියේ ප්‍රතික්ෂේප කර තිබෙන අතර, අදහස් ප්‍රකාශ කිරීමේ නිදහස සහ සිවිල් සමාජ අවකාශය ආරක්ෂා කිරීමට සහ ප්‍රවර්ධනය කිරීමට කැපවී කටයුතු කරමින්, ජනමාධ්‍යවේදීන්, මානව හිමිකම් ආරක්ෂා කරන්නන් සහ සිවිල් සමාජයට වෙත එල්ල කෙරෙන බවට චෝදනා කෙරෙන ප්‍රහාර සම්බන්ධයෙන් ලැබෙන පැමිණිලි පිළිබඳව විමර්ශනය කොට නඩු පවරන බවට සහතික වෙයි.
• විශේෂයෙන්ම  පාස්කු ඉරුදින එල්ල වූ විනාශකාරී ත්‍රස්ත ප්‍රහාරයෙන් අනතුරුව, ජාතික ආරක්ෂාව සඳහා ක්‍රියාත්මක වන සාමාන්‍ය ආරක්ෂක ජාලවලට අමතරව, ආරක්ෂක හමුදා සහ බුද්ධි අංශ මෙරට නිශ්චිත පුද්ගලයින් පිරිසක් අධීක්ෂණය කිරීමේ නිරත නොවන බව ද යළි අවධාරණය කරනු ලැබේ.
• එළඹෙමින් පවතින ලොව පුරා රැඩිකල් හා අන්තවාදී කොටස්වල උපායමාර්ගවල නවීනත්වය මධ්‍යයේ, සිය ජාතික ආරක්ෂක අවශ්‍යතා අනතුරේ හෙළන ඕනෑම රටකට කණගාටුදායක ප්‍රතිවිපාකවලට මුහුණ දීමට සිදුවන බව අපි විශ්වාස කරන්නෙමු.
• එබැවින්, මෙම සන්දර්භය තුළ දී එම මූලික යථාර්ථය පිළිබඳව සැලකිලිමත් වන ලෙස රජය සියලු පාර්ශ්වයන්ගෙන් ඉල්ලා සිටී.

 இலங்கையின்அறிக்கை

தலைவி அவர்களே,

இந்த சபைக்கு வழங்கப்பட்ட 'ஐக்கிய நாடுகள் சபை, அதன் பிரதிநிதிகள் மற்றும் மனித உரிமைகள் துறையில் உள்ள பொறிமுறைகள்' தொடர்பான பொதுச்செயலாளரின் வருடாந்த அறிக்கையில் உள்ள குறிப்பு தொடர்பாக இலங்கை அரசாங்கம் பின்வரும் அவதானிப்புக்களை மேற்கொள்ள விரும்புகின்றது:

• அறிக்கையில் குறிப்பிடப்பட்டுள்ள 'அச்சுறுத்தும் விஜயங்கள்', 'கண்காணிப்பு', 'துன்புறுத்தல் தொடர்பான முறைப்பாடுகள்' மற்றும் 'பழிவாங்கல்கள்' தொடர்பாக, குறித்த சம்பவங்களை விசாரணை செய்து நடவடிக்கைகளை முன்னெடுக்கும் முகமாக, சட்டத்தை நடைமுறைப்படுத்தும் அதிகாரிகளுக்கு அல்லது இலங்கையின் மனித உரிமைகள் ஆணைக்குழு அல்லது தேசிய பொலிஸ் ஆணைக்குழு போன்ற சுயாதீனமான தேசிய நிறுவனங்களுக்கு முறையான முறைப்பாடுகளை மேற்கொள்ளுமாறு சம்பந்தப்பட்ட தரப்பினருக்கு அழைப்பு விடுப்பதற்கு இலங்கை அரசாங்கம் விரும்புகின்றது.

• அரசாங்கம் ஏற்கனவே இந்தக் குற்றச்சாட்டுக்களை பகிரங்கமாக மறுத்துள்ளதுடன், கருத்துச் சுதந்திரம் மற்றும் சிவில் சமூக இடைவெளியைப் பாதுகாப்பதற்கும் ஊக்குவிப்பதற்கும் உறுதிபூண்டுள்ள அதே வேளை, ஊடகவியலாளர்கள், மனித உரிமைகளின் பாதுகாவலர்கள் மற்றும் சிவில் சமூகத்திற்கு எதிரான தாக்குதல்கள் குறித்து பெற்றுக்கொள்ளப்பட்ட முறைப்பாடுகளை விசாரணை செய்து, வழக்குத் தொடருவதனை உறுதி செய்கின்றது.

• தேசிய பாதுகாப்பின் நலனுக்காக வழக்கமான பாதுகாப்பு வலையமைப்புக்களை செயற்படுத்துவதனைத் தவிர, குறிப்பாக பேரழிவுகளை ஏற்படுத்திய ஈஸ்டர் ஞாயிறு தின பயங்கரவாதத் தாக்குதல்களுக்குப் பின்னர், பாதுகாப்புப் படைகள் மற்றும் புலனாய்வு அமைப்புக்கள் நாட்டில் எந்தவொரு குறிப்பிட்ட குழுவினரையும் கண்காணிப்பதில் ஈடுபடவில்லை என்பதும் மீண்டும் வலியுறுத்தப்படுகின்றது.

• உலகெங்கிலுமுள்ள அடிப்படைவாத மற்றும் தீவிரமான கூறுகளின் நுட்பங்களுக்கிடையில் தேசிய பாதுகாப்பு நலன்களை இணங்கச் செய்யும் எந்தவொரு நாடும் வருந்தத்தக்க விளைவுகளை எதிர்கொள்ளும் என நாங்கள் நம்புகின்றோம். எனவே, இந்த சூழலில் அத்தகைய யதார்த்தத்தை கவனத்தில் கொள்ளுமாறு இலங்கை அரசாங்கம் அனைத்து தரப்பினரையும் கேட்டுக்கொள்கின்றது.
